Case Story

A Night Of Drinking Turns Deadly

Norman Aaron Thomley and his wife went out for a night of drinking and partying.  At around midnight, the Thomleys left the bars and made their way to their pick-up truck to head home.  Aaron appeared very drunk but insisted on driving home, so they hit the road. Just after midnight, Aaron raced down State Highway 249 in no condition to be behind the wheel.  He sped along the quiet road, unaware what was ahead. Stopped at the light at S.H 249 and Zion Road was the Winborn family, on their way to a family reunion.  44-year-old Bobby Winborn was behind the wheel of the Chevy Blazer and their SUV was full.  He was driving Mary Winborm, Phllip Winborn, Phaedra Ritting, Bobbie Winborn and Hanna Garcia.  They waited at the red light; a red light Aaron Thomley apparently didn't see.

Witnesses See The Dramatic Collision

Numerous drivers on the road saw what happened next.  Thomley's one-ton pick-up truck slammed into the Blazer.  Sparks flew as the Winborn's SUV rolled into a ditch and erupted into flames. Other witnesses noticed Thomley stagger out of his truck saying, \"Please tell me there was no one in that truck.\"  Of course there were.  Three of the passengers were killed, while three others survived, left to deal with the pain. Aaron Thomley was arrested and taken into custody.  A full three hours after the accident, his BAC was tested and he registered an unfathomable .295.  That is almost three times the legal limit in Texas.  And that was three hours after the accident.

A Slam Dunk Trial

On December 3, 1996, Thomley was convicted of intoxicated manslaughter and intoxicated assault.  Usually, someone convicted of those types of crimes is taken into custody right away, but because of a paperwork error, Thomley was released.  He didn't wait long before he hit the road.
